State Human Rights panel unhappy with police report

THIRUVANANTHAPURAM: The Kerala State Human Rights Commission (KSHRC) has refused to accept the investigation report submitted by the Malappuram District Police Chief regarding the death of two Maoists in Nilambur forest area during police encounter.

The rights commission member K Mohan Kumar on Monday asked the State Police Chief to furnish a comprehensive report that includes the postmortem findings, first information report and magisterial inquiry report within three weeks.
Observing that the District Police Chief lacked jurisdiction or operational control over the special strike force which gunned down the Maoists, it asked the State Police Chief to furnish a detailed report.

The Malappuram District Police Chief who submitted the report also did not
answer specific questions posed by KSHRC. Police have been asked to inform State Human Rights Commission if procedures under CrPC 158 and 176 were followed in the incident to ascertain whether a magisterial probe was carried out or whether investigation into the incident has been assigned to any officer.
“The commission expects more careful and satisfactory report from police in cases involving human rights violation. The report of the Malappuram District Police Chief says Thunderbolt Commandos and ANS teams were deployed in Nilambur forest area.

However, it is unclear in the report as to who led the force. Only an officer of higher rank can ascertain whether use of force by the special team was necessary,” it observed.
 State Human Rights Commission also clarified that it needs the State Police Chief’s report, as the incident involves aspects that cannot be constrained to district and state boundaries.
