NEW DELHI: The Supreme Court on Thursday allowed withdrawal of the plea the wife of former Arunachal Pradesh Chief Minister Kalikho Pul, who had committed suicide last year, seeking a CBI probe into his death.
Senior advocate Dushyant Dave appearing on behalf of Pul’s wife and raised objections as to why the case was taken up on the judicial side when the order was passed on the administrative side.
Dave also questioned as to how the plea was listed before a bench of Justices A K Goel and U U Lalit and said, “We had filed the plea on the administrative side and not on judicial side and we do not want to participate in hearing it and want to withdraw the same.”
The court then allowed the plea.
Dave also stated that the bench cannot hear the case at hand as Justice Goel had worked with Chief Justice of India J S Khehar in Chandigarh High Court.
The 60-page suicide note had allegedly mentioned various politicians and few sitting judges.
“There are lot of allegations against judges and reputation of the institution will be affected if we don’t act in impartial manner,” Dave said adding that they are soon going to approach the Vice-President seeking prosecution of the judges involved.
Last week, Dangwimsai in a press conference held in Delhi made public the letter written to the Chief Justice of India and said, “It is essential that an FIR be registered on the basis of the allegations contained in it (suicide note) and the case be investigated by the CBI since the primary allegations are of corruption of judges at the highest level.”
CJI J S Khehar took note of the letter and forwarded the same to registry for listing of the case for hearing.
She had also alleged that her family was getting threats and she was advised not to hold the press conference in which she made the late chief minister's suicide note public.
Pul had committed suicide on August 9 last year and his body was found hanging in the official residence of the Chief Minister at Itanagar weeks after being unseated as the Chief Minister by a ruling of the Supreme Court.
She blamed the state government for its nonchalance in conducting a proper investigation into the former chief minister's death, despite an FIR by the family.
