

HYDERABAD: The CBI on Saturday filed its chargesheet in the Jagan Mohan Reddy illegal assets case, naming the Kadapa MP -- “in league with his father, the late Y S Rajasekhara Reddy” -- IAS officer B P Acharya and another official as part of a criminal conspiracy to defraud AP Industrial Infrastructure Corporation (APIIC) by securing the allotment of 75 acres of land each to Aurobindo Pharma Ltd and Hetero Drugs Ltd in the Jadcherla SEZ on a lease basis.
Named as accused no.1, Jagan has been charged with criminal conspiracy under different provisions of the Prevention of Corruption Act, 1988.
A total of 13 persons have been named as accused in the chargesheet.
Besides Jagan, the 68- page chargesheet names his confidante V Vijay Sai Reddy as accused no.
2.
while Acharya -- already facing charges in the Emaar scam -- finds himself in deeper trouble, included as accused no.9 in the Jagan case as well.
A total of 263 documents have been cited in chargesheet, which also names 66 witnesses.
According to CBI, Jagan got shares allotted to himself at par, initially in M/s Jagati Publications Pvt Ltd (accused no.
12) and M/s Janani Infrastructure Pvt Ltd (A-13) and later mobilised quid pro quo funds from companies and individuals who had benefitted from allotment of lands in industrial parks and other ventures developed by APIIC in the special economic zone (SEZ) at Jadcherla, circumventing government guidelines by using the influence and offices of then chief minister Y S Rajasekhara Reddy.
The CBI said Jagan, who is the chairman and director of JPPL, dishonestly concealed facts relating to the profitability and turnover of the company, and solicited investments at a high premium as a quid pro quo from companies like Aurobindo Pharma (A-3) through the family members of its managing director K Nityananda Reddy (A-7), M/s Trident Life Sciences Ltd (A-5) and M/s Hetero Group of Companies (A-4) and its director M Srinivasa Reddy (A-6).
In reality, the chargesheet said, JPPL has not been able to achieve any profit till now.
The CBI further said Jagan, in league with the late Rajasekhara Reddy, Acharya, the then managing director of APIIC, and Y V L Prasad (A-10), the then zonal manager of APIIC, hatched a criminal conspiracy to defraud the corporation by getting the allotment -- on a lease basis -- of 75 acres of land each to Aurobindo Pharma and Hetero Drugs in the Jadcherla SEZ on a lease basis and securing the transfer -- on outright sale -- of 30.33 acres of land at Pashamylaram to Trident Life Sciences Ltd at a relatively low lease premium and sale consideration respectively.
As a quid pro quo for favours conferred on these companies, Jagan, with active assistance from Vijay Sai Reddy, persuaded them to invest in his companies -- JPPL and Janani Infrastructure by purchasing shares at a high premium, the chargesheet said.
‘’Thereby, Jagan, Vijay Sai and YSR hatched a conspiracy to defraud the government with the help of B P Acharya (and other individuals), and other group companies joined the conspiracy and were benefitted out of the nefarious deal and are therefore liable for hatching and joining conspiracy under Section 120B,’’ it said.
The CBI said Jagan actively prevailed upon his father to commit an offence under Section 11 of the PC Act, 1988, who in turn prevailed upon B P Acharya and Y V L Prasad to materialise the nefarious deal of allotting the lands to the accused companies by circumventing the laid down norms detrimental to the interest of APIIC and thereby the government o f Andhra Pradesh.
The agency said that by such overt acts, Jagan committed offences under sections 12 of PC Act, 1988 by abetting his late father, Y S Rajasekhara Reddy, the then chief minister, to commit and also to cause to commit the offence of criminal misconduct under Sections 11 and 13 (2) read with 13 (1) (d) of the PC Act, 1988

The LAWS BREACHED
The accused have been chargesheeted for criminal conspiracy, criminal breach of trust, cheating, falsification of documents for the purpose of cheating, use of forged documents as genuine, abuse of official position in allotment of lands at SEZ, Jadcherla and Pashamylaram.
Section 120-B, read with 420, 409, 420, 468 and 471 IPC and section 11, 12, 13 (2) read with 13 (1) (c) and (d) of PC Act, 1988.
