Defection case: Petition against Kodela dismissed

In a relief to Kodela and Akhila Priya, the bench dismissed the petition filed against the Speaker and the minister as not maintainable.

HYDERABAD: A division bench of the Hyderabad High Court on Thursday made it clear that mere failure of the Assembly Speaker Kodela Siva Prasada Rao to take action against defected MLA Bhuma Akhila Priya (from YSR Congress to ruling Telugu Desam Party in AP) for disqualification would not make the former a usurper to the office of the Speaker. In a relief to Kodela and Akhila Priya, the bench dismissed the petition filed against the Speaker and the minister as not maintainable. 

The bench comprising Justice V Ramasubramanian and Justice N Balayogi was passing this order in a petition by G Malleswara Rao seeking to restrain the defected MLA Bhuma Akhila Priya from discharging duties of a member of legislative assembly or of a minister in the state cabinet.
