VIJAYAWADA: A public interest litigation (PIL) has been filed in the Andhra Pradesh High Court challenging the State government’s recent orders providing 34 percent reservation for Backward Classes (BCs) in Panchayat Raj institutions and 33.33 percent in municipalities and municipal corporations. The petition, filed by advocate Tandava Yogesh, challenges GOs 1065 and 105 issued by the government on August 19 and 20.
The petitioner contended that the orders could result in total reservations for SCs, STs and BCs exceeding the constitutionally recognised 50 per cent ceiling. In his petition, Yogesh sought directions to modify the government orders so that the combined reservations in local bodies remain within 50 percent.
He also asked the court to direct the government to produce the note files, legal opinions and records forming the basis for issuing the two GOs. The petition was mentioned before a division bench comprising Chief Justice Justice Lisa Gill and Justice Challa Gunaranjan on Monday.
The bench said it would hear the matter on Tuesday. The petitioner relied on earlier Supreme Court and High Court judgments, including the 2010 K Krishnamurthy case.
