SHIMOGA: The district and sessions court on Tuesday dismissed a revision application filed by an advocate requesting another probe into the death of Mytradevi, wife of Chief Minister BS Yeddyurappa, and slapped a fine of Rs 10,000 on the petitioner.

Judge SM Shivanagowdar ordered the second JMFC to collect a fine of Rs10,000 from advocate Sheshadri who submitted the plea.

The incident

Mytradevi had fallen into a water tank at her house in Shimoga on October 16, 2004, and died. Doddapet police registered a case and the investigation revealed that it was an accidental death.

Advocate Sheshadri filed a complaint at the second JMFC on January 31, 2009, seeking reopening of the case.

The court directed the Doddapet police to conduct another probe. A report was submitted to the court on March 4, 2009, after the probe.  Sheshadri again filed an objection to this probe, but the court rejected his application on September 3, 2009.

Revision application

Sheshadri again submitted a revision application to the district and sessions court.

Reasons cited

The judge cited the following reasons for dismissing the plea: A private complaint was lodged four years and three months after the death; applicant had not mentioned the reasons for delay and personal information about the incident had not been provided during argument or in the plea and evidences mentioned while filing a private complaint were not from eyewitnesses or circumstantial evidences.
