MYSURU: A court in Gundlupet on Tuesday ordered that summons be served on Cooperation Minister H S Mahadeva Prasad through a proper channel without fail in connection with a false affidavit he allegedly filed during the last Assembly elections.
With this, authorities concerned should serve summons on Mahadeva Prasad through Speaker Kagodu Thimmappa or through the Chamarajanagar superintendent of police.
Mallikarjun, the complainant’s advocate, said that since the police repeatedly failed to serve the summons, Judge D Kamalaksha directed serving the summons through the Speaker or SP.
This order comes as Mahadeva Prasad, who is also the Chamarajanagar district-in-charge minister, failed to turn up at the court for the second time in the last three months. Mallikarjun alleged that despite court directions, the police were avoiding serving summons though Mahadeva Prasad visits the district frequently.
Complainant L Suresh, a former president of the Gundlupet municipal council, said he had filed a petition on April 15, 2103 at the local court accusing Mahadeva Prasad of not showing the land he owned in the affidavit filed along with his nomination papers for last Assembly election. The estimated value of the 3.22-acre land in survey No 165 in Arepura of Gundlupet taluk with a running quarry was worth `50 lakh, he said.
Registering a private complaint, the Civil Judge (Junior Division) and JMFC had directed the local police to serve summons on Mahadeva Prasad asking him to appear before this court in August, 2014. But police did not execute the order, the complainant alleged.
Again the court directed the police to serve summons on Mahadeva Prasad to appear in person on Tuesday. But the police allegedly did not serve the summons.
The matter was adjourned to April 4.
