KOCHI: Kerala High Court on Friday directed the producers of the movie ‘Garbhasreeman’ to furnish a bank guarantee of `5 lakh after finding that the script of the Suraj Venjaaramoodu-starrer was copied.
The court also lifted the ban imposed on release of the film.
Justice B Kemal Pasha issued the directive after Sudheesh Kumar, of Perumbavoor, moved the court alleging that the script of the film had been penned by him in 2008 and it was plagiarised by the makers of ‘Garbhasreeman’.
He approached the HC after the district court dismissed his claim.
Sudheesh filed a plea against T S Jayakumar, the producer of the film, director Anil Gopinath, Harish P and Suvachan.
The court found that the script prepared by Suvachan, based on which the film was produced, was almost a reproduction of the story written by Sudheesh Kumar in 2008.
Considering facts such as the huge amount of money invested in the project and the nearing date of the film’s release, the court was of the view that equitable relief can be sufficiently compensated in terms of the money.
The High Court observed that the bank guarantee of `5 lakh should be active while the suit filed by the petitioner is pending before the Ernakulam District Court.
