Why no Action against Bijimol in Assault Case, HC Asks CB

KOCHI: Expressing displeasure over the inaction of the Crime Branch in taking action against CPI Peermade MLA E S Bijimol, the Kerala High Court on Tuesday directed the Crime Branch to file a report in two weeks, explaining why the arrest of the MLA was not required in the assault case. Bijimol is the accused in a case related to the alleged assault on Additional District Magistrate (ADM) at a private estate at Thekkemoola, near Peruvanthanam, where he had gone to implement a High Court order.

Justice B Kemal Pasha issued the directive on a petition filed by Idukki ADM Moncy P Alexander seeking a directive to the Crime Branch to complete the investigation expeditiously and submit the final report before the court.

The court observed that the investigation officer could not say that a member of the Assembly was absconding. He asked why the arrest of the concerned accused was not required under the provisions of section 41(1) (b) of the Code of Criminal Procedure.

Moncy Alexander submitted that the case had been handed over to the Crime Branch three month back, there was no progress in the investigation and no effective steps were taken by the CB to proceed with the investigation. He said that even after the incident occurred on July 3, 2015, several insulting and defamatory complaints were made by Bijimol through different media against him. He was referred to the medical college and was discharged after prolonged treatment after the incident. The Crime Branch investigation was ordered by the High Court when he was aggrieved by the lethargic attitude of local police. “Though the order was passed almost three months ago there was no progress in investigation and no effective steps were taken by the Crime Branch to proceed with the probe,” he said. According to him, he went to the place with the aid of police to reinstall the gate of an estate in pursuance of the directive of the district collector to implement an interim order of the High Court.

The petitioner had made all efforts to explain the circumstances to the people who had gathered there. They were fully aware of the interim order. However, Bijimol shouted at the petitioner and pushed him down. The MLA also prevented the petitioner from discharging his official duties.  The police had registered a case charging the MLA with the offence under section 143 (unlawful assembly), 147 (rioting), 188 (Disobedience to order duly promulgated by public servant) and 353 (Assault or criminal force to deter public servant from discharge of his duty).
