Blocking roads by political parties during culmination of election campaigns should end: Justice Kamal Pasha

KOCHI: Justice B Kemal Pasha, a sitting judge of the Kerala High Court, has sent a letter seeking court's intervention against blocking of roads under the guise of celebrating the culmination of election propaganda by dancing on the middle of the road.

Justice Pasha was also a scapegoat when he was virtually stranded for more than two hours in between Aluva and Angamaly stretch on the high-pitched finale of election campaigning.

In the letter, Justice Pasha stated that the political parties or persons under them have no right to make use of the public road as a playground at their whims and fancies. "At any cost, they should be restrained from such activities through necessary judicial intervention at the earliest," he said.

"It is hard reality that the literate public in Kerala had to face severe agony on  various roads in Kerala in the afternoon and evening of  of May 14 on account of severe traffic block in National High Ways and other roads. In almost all the important road junctions, persons and other hooligans under the guise of celebrating the culmination of election propaganda were dancing on the middle of the road by blocking the entire traffic," he pointed out.

On the last day of the election campaign, Justice Pasha had gone to attend an award distribution function. But he reached there 1.30 hr late. At the same time the person who have to receive the award could not reach the place due to the traffic block. 

Justice Pasha said that he could learn that in the National Highway the entire traffic was blocked from Aluva to Angamaly and also from Chalakudy to Angamaly for about five hours. "I could witness persons dancing on the road and policemen aiding them by blocking the entire traffic. All the public including poor children were stranded on the road for more than five hours due to the 'inhuman' activities. The same has to be stopped," the letter stated.

Justice Pasha said that it is high time to have a judicial intervention to prevent the recurrence of such inhuman activities. The activities by which the public was stranded at the road for more than five hours was nothing but flagrant violation of the protection guaranteed under Article 21 of the Constitution of India.

The Registrar-Subordinate Judiciary placed matter before the judicial side of the court as Suo Mottu Public Interest Litigation. The court will consider the case on Monday.
