CHENNAI: In a counter-affidavit filed in the Madras High Court on Friday, the CBI has said that the petitioner is in the habit of filing false complaints against TNCC president K V Thangkabalu.

The counter was filed in response to a petition filed by V K Palanivelu of Veng ampatti in Salem district, alleging that Than gkabalu had accumulated assets in his name and in the names of his close relatives, which were disproportionate to his known sources of income.

The CBI said that Palanivelu had made a similar complaint against Thangkabalu on April 22, 2004, on the eve of the Lok Sabha elections. And by a communication dated February 27, 2009, he was informed about the action taken on his complaint.

The petitioner also made a complaint against Thangkabalu on March 6, 2009, the CBI said.

The CBI further said that the Tamil Nadu government, by a communication dated April 9, 1989, stipulated three conditions, while extending the powers under the jurisdiction of the Special Police Establishment (CBI) for investigation of offences in the State. The member of Parliament did not fall under any of the three categories because Thangkabalu could not be treated as a Union Government servant or an officer belonging to the public sector and the disproportionate assets offence did not fall under the second category.

The case did not fall under the first category as well, because the Prevention of Corruption Act comes under the concurrent list of the Constitution.

However, the matter has been forwarded to the secretary general of the Lok Sabha for appropriate action.

When the petition came up for hearing on Friday, advocate K Ramakrishna Reddy told Justice K Suguna that no notice was served on Thangkabalu till date, as directed by the judge earlier.
