Observing that courts should exercise caution in granting bail to the accused in serious criminal offences, the Madras High Court (Madurai Bench) on Tuesday cancelled the bail granted to the prime accused in the murder of Naam Tamilar Katchi state organiser Suba Muthukumar.
Dismissing a bail petition filed by the accused Gopal alias Gopalakrishnan, Justice N Kirubakaran said merely because the charge-sheet is filed in a case, it will not automatically entitle an accused to obtain bail.
Stating that “the case proves how the people who take to crime as a way of life are a threat to the safety andsecurity of the people,” the judge said “a person like the petitioner, who has as many as 17 cases filed against him, cannot be enlarged on bail. It may not be in the interest of the society to release him on bail.”
Muthukumar was murdered by a gang in Pudukottai in February 2011. The case was investigated by the CB-CID.
Essar Gobi Gets Bail
Meanwhile, the Madurai Bench granted anticipatory bail to Essar Gobi, executive committee member of the DMK and a close aide of former Union Minister Alagiri, in an extortion case.
Justice KBK Vasuki granted the anticipatory bail to Essar Gobi and directed him to appear and sign before the Tiruchy Judicial Magistrate for four weeks.
Essar Gobi, in his petition, stated that the Subramaniyapuram police registered a case against him based on a complaint from one Kaali Selvan, Manager of Eyarkai Vegetable Market in Palanganatham, who said that Essar Gopi, Bose Muthaiah, councillor of ward 61 of Madurai Corporation and his friend Nagendran trespassed into the shop and demanded Rs 10,000 as ‘mamool’.
Further the petitioner said that his political opponents had instigated Kaali Selvan to lodged a complaint against me.
