A division bench of the Madras High Court has stayed the operation of the interim orders of a single judge restraining the Jawaharlal Institute of Post Graduate Medical Education and Research (JIPMER), Puducherry from acting upon a notification dated September 14 this year, which provisionally selected 465 staff nurses to the institution.
Considering the orders passed earlier on October 23 by the first bench dismissing another writ petition with similar prayer, the present bench of Justices Chitra Venkataraman and TS Sivagnanam granted the injunction while passing interim orders on a writ appeal from the Director of JIPMER, on Monday.
Originally, while passing interim orders on a writ petition from P Thamizharasan on October 18, Justice T Mathivanan had granted the injunction. Aggrieved, JIPMER filed the present appeal.
Appellant, among other things, contended that the writ petition contained factual errors. Reckless allegations had been made against the Institute without any basis. The entire process of recruitment was conducted in a transparent manner, adhering to the rules and regulations prescribed by the Department of Personnel and Training, New Delhi. The figures given by the petitioner and relied upon to make unfounded allegations against JIPMER were completely baseless, inaccurate and incorrect. The writ petitioner had failed to substantiate the allegation that three officials of the institution had collected `20 lakh each from the selected candidates, appellant contended.
Further hearing on the main writ appeal to quash the single judge order was adjourned by three weeks.
