HYDERABAD: The Hyderabad High Court on Tuesday refused to direct GHMC to immediately open the Film Nagar Club.
Justice M S Ramachandra Rao was dealing with a petition by the Film Nagar Cultural Centre (FNCC) seeking to declare the action of GHMC authorities in seizing the entire club premises of the petitioner on July 24, 2016 as illegal. The civic authorities seized its premises without issuing any prior notice under the GHMC Act, the petitioner pointed out.
The counsel for the GHMC submitted that the authorities seized the premises of the club following death of two construction workers due to collapse of an under-construction portico inside the FNCC on July 24 in order to ensure that no further construction will be taken up on the premises.
Intervening, advocate C Damodar Reddy brought to the notice of the court that the High Court had already granted interim stay on the construction activity on the premises in a petition filed by his client Kosaraju Jyothi Prasad.
While placing copy of the interim order granted on July 23, 2016, the advocate said that the high court had directed the GHMC to ensure that the club shall not undertake any construction in deviation of the permission already granted till further orders and also sought a status report from the GHMC.
After perusing the interim order, Justice Ramachandra Rao refused to grant interim relief to the FNCC and adjourned the matter.
