Telangana HC stays inclusion of retired judge’s lands in prohibited list

HYDERABAD: The Telangana High Court has granted interim relief to retired judge Justice Abhinand Kumar Shavili and his brother Ashok Kumar Shavili by suspending proceedings of the Rangareddy district collector that brought their lands under the prohibited properties list maintained under Section 22-A of the Registration Act, 1908.

The petitioners challenged the collector’s Form-I proceedings, contending that the inclusion of their lands in the prohibited list was arbitrary and unconstitutional, besides violating Articles 14 and 300A of the Constitution and the provisions of the Registration Act. 

‘Land assigned to petitioners without curbs’

According to the petition, the former Telangana High Court judge owns 3 acres and 26 guntas in Survey No.103/45 AA and his brother owns 1 acre and 4 guntas in Survey No.103/45 E in Gubbadi village of Shamshabad mandal. They sought to set aside the proceedings insofar as their properties are concerned.

Counsel for the petitioners submitted that the lands had been assigned to their vendors before 1952 without any restriction on alienation. The petitioners later purchased the properties through registered sale deeds in 1986 and 1989, following which revenue authorities mutated the lands in their names and issued pattadar passbooks.

It was argued that restrictions on transfer of assigned lands came into force on July 25, 1958, and could not be applied retrospectively to earlier assignments. The petitioners also sought directions to remove the lands from the prohibited properties list and issue pattadar passbooks under the Bhu Bharathi (Record of Rights in Land) Act.

Justice Pulla Karthik issued notices to the authorities and adjourned the matter to June 30, 2026.
