No construction activity for a complex will be carried on the disputed site in T Nagar, the Nadigar Sangam Charitable Trust has assured.

CHENNAI:  No construction activity for a complex will be carried on the disputed site in T Nagar, the Nadigar Sangam Charitable Trust has assured a vacation bench of Madras High Court on Saturday.

When the PIL from KM Srirangan and R Annamalai, residents of Vidhyodaya Colony, came up before Justices N Kirubakaran and V Parthiban at a special sitting,  counsel for the Trust gave an undertaking to this effect.

And the bench appointed an Advocate-Commissioner(AC) to inspect the site, where the Nadigar Sangam Charitable Trust and South Indian Artistes Association (SIAA) are alleged to be making constructions by encroaching upon a 33 feet wide public road abutting Habibullah Road.

K Elangoo, who is appointed as AC, would measure the property of Nadigar Sangam with the assistance of  the Assistant Director of Survey and the Tahsildar, Guindy taluk. Both would co-operate with the AC and extend all  assistance by providing all the documents.

The AC is at liberty to seek all records from the revenue department and the Corporation of Chennai, the bench said and posted the PIL to June 2.

According to petitioners, the colony has two approach roads to reach Habibullah Road, one through Kodambakkam High Road and the other the 33 feet road connecting Habibullah Road and Prakasam Street. The second one being the shortest, most residents and school children use it to reach the colony.
