‘No jurisdiction to hear pleas on disqualification of O Panneerselvam, MLAs’

CHENNAI: Senior counsel C S Vaidyanathan on Thursday said the High Court has no jurisdiction to hear petitions seeking to disqualify O Panneerselvam and 10 other MLAs.

DMK Whip Sakkarapani had sought to disqualify Panneerselvam and others, who had earlier voted against the government led by Edappadi K Palaniswami.

In his arguments before the First Bench comprising Chief Justice Indira Banerjee and Justice Abdul Quddhose, the counsel argued that when the Assembly Speaker had not passed any order on the representation given to him that all these legislators had violated the whip, the court could not interfere.

He said the question whether the MLAs can be disqualified when the Speaker had not passed any order, was pending adjudication before the Supreme Court.

The Bench then adjourned the matter for hearing submissions of counsel for the DMK to February 27.
