CHENNAI:We have built a house in a village panchayat area in 2012 by leaving set back area on all sides. A year later, our neighbour, in our absence built his house attached to our compound wall itself.

We objected to it orally and he agreed not to keep ventilators and windows towards our side. But now they are forcing us to allow put ventilators on their walls facing our side. Is it not legal what we are demanding? If they forcefully keep ventilators open, what remedy we have?

Unless the area requires CMDA approval, the houses in the villages can be built adjacent to each other (street houses). Since you had left set back space he is entitled to have his windows fixed on the wall separating your house compound with his house. The only right that you can have is that you can prevent him from putting a further construction on the top of your compound wall. He has to raise a separate wall adjacent to your compound.
