HYDERABAD: In a setback to the Nagarjuna Construction Company (NCC) Limited, a division bench of the Hyderabad High Court has recently dismissed an appeal filed by the firm challenging the action of the Sembcorp Gayatri Power Limited in invoking the bank guarantees furnished by the former. “We see no reason to restrain the first respondent (Sembcorp) from invoking the bank guarantees furnished by the appellant (NCC), as these bank guarantees are unconditional and unequivocal, and the appellant has neither made out a case of fraud vitiating the contract of bank guarantee nor of special equities justifying an order of injunction being granted restraining invocation of the bank guarantees”, the bench observed while dismissing the appeal.
The bench of Acting Chief Justice Ramesh Ranganathan and Justice T Rajani was dismissing the civil miscellaneous appeals filed by the NCC Limited against the order passed by the XXIV Additional Chief Judge-cum-Commercial Court, Hyderabad.After hearing the case and perusing the material on record, the bench dismissed the appeal saying that it appears the provisional acceptance of one and two units were not achieved till the jurisdiction of the Commercial Court was invoked by the appellant on March 6 this year.
The bench, however, directed the Sembcorp Gayatri not to encash bank guarantees for two weeks since the appellant NCC Limited wanted to approach the Supreme Court on the issue.
Sridhar Babu moves HC to quash drugs case against himFormer minister and Congress leader D Sridhar Babu approached the Hyderabad High Court on Thursday with a plea to quash the criminal case registered against him recently under the Narcotic Drugs and Psychiatric Substances (NDPS) Act at Chikkadpally police station in the city.
Sridhar Babu, in his petition, alleged that the case was registered in view of his political differences with the ruling TRS in the state. The case itself indicates the motivated nature of the complaint and also choosing of a particular police station, he stated. The Congress leader named the Telangana government and TRS leader P Kishan Reddy as respondents. The matter is expected to come up for hearing in a day or two. .
Kaleshawaram: Arguments continue in HC
The Telangana government on Thursday told the Hyderabad High Court that the multi-purpose Kaleshwaram project would be utilised only for the needs of drinking water if environmental clearance was not received for the project. Though the project was taken up for irrigation, drinking water and industrial purposes works were now taken up for the drinking water component of the project and that the works for irrigation purpose would be commenced only after obtaining necessary clearances, it noted.
In this regard, Telangana advocate general D Prakash Reddy made submissions before a division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice J Uma Devi dealing with petition filed by Telangana government seeking to set aside the order of National Green Tribunal (NGT) at Delhi which stayed the works regarding Kaleshwaram project.
HC adjourns case on teachers’ recruitment
Justice A Rajasheker Reddy on Thursday adjourned the case challenging the notifications issued by the Telangana government to recruit 8,792 teachers in the education department, by one week.
The judge was dealing with a petition filed by K Balakrishna Mudiraj and others seeking cancellation of the notifications issued for teachers’ recruitment who included school assistants, physical education teachers, language pandits, and secondary grade teachers.
