Plea to examine mobile phone calls: Order of ACJM court quashed

The Ernakulam Additional Sessions Court has quashed an order issued by the Additional Chief Judicial Magistrate Court which dismissed the plea to examine the mobile phone calls and SMSs between the then Kochi CBI unit SP Shyni and DIG Sreejith in connection with a criminal case.

Judge D Sarangadharan issued the order while considering a petition filed P V Viju, proprietor, Marine Ventures, challenging the ACJM order. The petitioner is an accused in a cheating case registered by the CBI. The petitioner had availed of business loans from Canara Bank, Ernakulam branch, and a substantial amount remains unpaid to the bank.

According to the CBI, the petitioner cheated the bank and misappropriated public money.

However, the petitioner submitted that the case was fabricated by the officials of the CBI Kochi unit after being persuaded by Sreejith who is a friend of Shyni.The petitioner pointed out that when Shyni took charge as the SP of Kochi Unit, she made a discrete inquiry against him under the influence of Sreejith.

He submitted that the phone call details are necessary for the trial of the case. The CBI vehemently opposed the plea and submitted that the petitioner is trying to collect evidence for another case pending between him and a senior IPS officer of the state police.
