Thettayil case: Complainant claims justice was denied

The woman who lodged the complaint against Jose Thettayil MLA on charges of sexual harassment said that justice was denied to her by the police, the ruling party and the Opposition party. She was speaking to reporters after consulting her lawyer at Kochi on Monday.

According to the victim, she has faith only in the judiciary for getting justice. “I did not get justice from the police, the government or the Opposition but I have full faith in the judiciary”, she said. She alleged that after she lodged the complaint against Thettayil, he had threatened her over the phone. “He called me over the phone and threatened me. I have recorded the conversation and have given the details to my advocate. I have also informed the police about the conversation”, she said.

According to her lawyer Shabu Sreedharan, they will file a petition in the High Court for lifting the stay ordered by the court on the investigation of the case for 10 days.

“We will request the High Court to lift the stay and allow the police to continue investigation as per Section IPC 376”, he said adding that IPC 376 would be valid in the case and there is nothing in the complaint stating that the victim purposefully trapped Thettayil after inviting him to her house.

Aluva police had registered a case in June against Thettayil and son for sexual harassment. After the incident came to light, Jose Thettayil went underground. Last week, the High Court had ordered a stay on the police investigation for 10 days. After the court order, Jose Thettayil appeared before the media and said that he was trapped by the woman in the case.

The High Court is to consider the petition filed by Jose Thettayil for quashing the FIR of the case on Tuesday.
