Plea seeks to keep seat reservation in JIPMER to locals

A writ petition has been filed in the Madras High Court for a directive to the authorities concerned not to fill up the seats reserved for Puducherry Scheduled Caste in JIPMER.

CHENNAI: A writ petition has been filed in the Madras High Court for a directive to the authorities concerned not to fill up the seats reserved for Puducherry Scheduled Caste in Jawaharlal Institute of Postgraduate Medical Education and Research (JIPMER) with non-Puducherry SC communities.

Justice K Kalyanasundaram, before whom the writ petition from A Sarandev, who was denied a seat, came up for hearing ordered notice to Medical Council of India (MCI) and JIPMER  returnable by June 26.

According to the petitioner, JIPMER has reserved six seats in MBBS course under P-SC category and such seats are available only to persons belonging to Scheduled Caste students of Puducherry. Recently, the institute released its merit list for P-SC category in which the petitioner was ranked in 10th position. A careful scrutiny of the list revealed that students in 1,2,4,6,7 and 8 do not fall under P-SC category since their origin was not Puducherry, the petitioner’s counsel Srinivasan said.

Relying on two Constitution Bench judgements of the Supreme Court, the petitioner said the Apex Court in the judgements had unanimously arrived at a view that migrants are not entitled to the benefits of reservation in the migrated State or Union Territory.

He then wanted the court to direct the institution to make the admissions to MBBS courses only in strict conformity with the Supreme Court judgments.

As an interim relief, the petitioner sought the court to direct JIPMER to reserve one seat under the P-SC category pending disposal of the plea.
