HYDERABAD:In a relief to the state government, a vacation bench of the Hyderabad High Court on Thursday refused to stay the interim order given by a single judge which paved the way for dispossession of the farmers of Goliwada village in Peddapally district of their lands for construction of a pump house for Sundilla barrage under the Kaleshwaram lift irrigation scheme.

The bench of Justice Challa Kodanda Ram and Justice N Balayogi heard the appeal of the aggrieved farmers, who challenged dismissal of their miscellaneous petitions by a single judge and the letter issued by Chief Commissioner Land Administration (CCLA). After hearing both the sides, the bench expressed its disinclination to stay the single judge’s order on the ground of lack of balance of convenience in favour of the appellants.

While admitting the appeal, the bench directed the registry to post the writ appeal which will come up for hearing in June. Earlier, on May 6, the single judge dismissed two petitions challenging the order passed by the CCLA on April 26, 2017 allowing the district collector to enter the lands of the petitioners and take up construction activity.
