HYDERABAD: With the deadline for getting “local status” for employees returning to Andhra Pradesh and also for implementation of Section 108 of AP Reorganisation Act, 2014 coming to an end on June 2, Andhra Pradesh and Telangana governments have requested the central government to extend the deadline by two years.


The “local status” provision given to AP-returning employees by the President will end on June 2. This will pose a great problem to employees working in the High Court and other departments where  bifurcation is yet to be completed.


“Telangana police personnel too demanded extension of ‘local status’ for employees going to AP. Some police staff did not know whether they would be allotted to AP or TS due to court cases and other problems,” a senior official of AP government told Express. AP and TS, therefore, requested the Centre to extend the deadline as regards “local status.”

As per the orders issued by the Centre on “local status”, those migrating from Telangana to Andhra Pradesh within a period of three years from June 2, 2014 will be treated on a par with local candidates for admissions to higher educational institutions and direct recruitments to government service. The three-year period is coming to an end on June 2, officials said.


Likewise, both the states wanted extension of the deadline for implementation of Section 108 of AP Reorganisation Act, 2014 for removing the difficulties in enforcing the Act.


Section 108 (1) of AP Reorganisation Act says: “If any difficulty arises in giving effect to the provisions of this Act, the President may, by order, do anything not inconsistent with such provisions which appears to him to be necessary or expedient for the purpose of removing the difficulty: Provided that no such order shall be made after three years from the appointed day”.


The President has issued three orders under Section 108. One was on inclusion of seven mandals of Khammam district with AP. The other two orders were for rectifying the typographical errors in APRA, 2014 with regard to number of MLC seats. If the deadline for Section 108 elapses, then the President cannot remove the difficulties by an order. It should be addressed by a federal separate Act. “That is why both the states are demanding extension of time for implementation of Section 108,” an official said.
