Eshwarappa gets HC relief in assets case

BENGALURU: The High Court on Monday quashed the proceedings against BJP leader K S Eshwarappa and his family members in relation to a disproportionate assets case pending in Shivamogga.

Justice Anand Byrareddy quashed the order passed by the Lokayukta Special Court in Shivamogga taking cognizance of the offence and summons issued to Eshwarappa and two of his family members, while disposing a criminal petition. Observing that the trial court did not record the sworn statement of the complainant as required under the law before taking cognizance of the private complaint, Justice Byrareddy remanded the matter back to the Lokayukta Special Court to proceed in the mater after complying the due process of law. BJP leader in the Council Eshwarappa, his son K E Kantesh and daughter-in-law Shalini had filed this petition.

The Lokayukta Special Court had initiated proceedings under Prevention of Corruption Act against all the three accused based on a private complaint filed by one Vinod, an advocate.

Vinod had approached the Lokayukta Court in 2012 alleging that Eashwarappa and his family possessed disproportionate assets.
