Hospital can be built on gomala land, rules Karnataka HC

While dismissing the petition filed by residents of R Thimmasandra village in Srinivasapura taluk of Kolar district, a division bench said that setting up of the hospital is unnecessary.

BENGALURU: The Karnataka High Court has dismissed a public interest litigation filed opposing the construction of a super speciality hospital on gomala land reserved for cattle grazing by the state government. The court observed that it would not be operating against public cause if the hospital was allowed to be built on the gomala land.

While dismissing the petition filed by residents of R Thimmasandra village in Srinivasapura taluk of Kolar district, a division bench said that setting up of the hospital is unnecessary. “The very purpose for which the cattle grazing land has been reduced and the extent of reduction ex facie show that the authorities have attempted to balance the requirements of cattle grazing and those of healthcare facilities. ”, the court said.

The court also said it is not open for the petitioners to contend that the requirements of cattle grazing override the requirements of appropriate healthcare facilities.
