Madras High Court Raises Mishap Compensation from Rs 1.26 Lakh to Rs 3 Lakh

HC held that the compensation given under the heads 'disability' and 'pain and sufferings' was very low and that compensation under 'loss of amenities' should have been awarded.

CHENNAI: The Madras High Court held that the compensation given under the heads 'disability' and 'pain and sufferings' was very low and that compensation under 'loss of amenities' should have been awarded. The court  enhanced the sum from `1.26 lakh to `3 lakh.

Justice S Vaidyanathan raised the compensation while passing orders on an appeal from N Dileepkumar (20), a third year student of Dr MGR Engineering College, who met with an accident while riding pillion on a two wheeler on ECR near Muttukkadu involving a college bus on January 26, 2003.

By an award dated January 30, 2010, the Motor Accidents Claims Tribunal (FTC-III) in Chennai, ordered a compensation of `1.26 lakh against the claim of `3.66 lakh which the Madras High Court revised to `3 lakh later.
