HC Orders Land Compensation Re-determined

HYDERABAD: In a major relief to property holders who have lost their land for widening of roads for construction of Hyderabad Metro Rail, the High Court on Tuesday directed the land acquisition officer (LAO) of the city to re-determine the compensation in accordance with the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, in the cases where the compensation was determined after January 1.

The grievance submitted from all the petitioners is that the award was passed after Jan 1 this year whereas the amount of compensation payable was determined in accordance with the provisions of Land Acquisition Act, 1894 which was repealed by the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

Justice Naveen Rao remitted all the cases of the petitioners to the LAO for re-determination of the  required compensation payable to the property holders and directed the LAO to fix the correct date of hearing, cause notice on the petitioners and afford an opportunity of hearing to them, consider the claims with reference to the determination of appropriate compensation.
