Delhi Police today admitted in a court that it had missed out on mentioning the most serious charge of murder in the chargesheet against the accused in the gangrape-cum-murder case and played down the mistake claiming "it was a typo error".

Delhi Police today admitted in acourt here that it had missed out on mentioning the mostserious charge of murder in the chargesheet against theaccused in the gangrape-cum-murder case and played down themistake claiming "it was a typo error".

Police told Metropolitan Magistrate Namrita Aggarwal thatit "has somehow missed out on mentioning section 302 IPC inthe cover of the chargesheet. It is a typo error."

The typographical error was pointed out a few minutesafter the court had taken cognizance of the chargesheet andnoted that a prima facie offence under sections, 302 (murder),307 (attempt to murder), 376 (2)(g) (gangrape), 377 (unnaturaloffences), 395 (dacoity), 396 (murder in dacoity), 394(hurtingin dacoity), 201 (destruction of evidence), 120B (conspiracy),34 (common intention) and 412 (dishonestly receiving stolenproperty) of the IPC is made out against all the accused.

"We have mentioned section 302 IPC in the chargesheetand also in the concluding portion where we seek their trialfor the offences of murder and under other sections.

"We want to move an application to correct the mistake. It was a typographical error," Public Prosecutor Rajiv Mohansaid. The judge, however, said there was no need for any suchapplication as the chargesheet will be read as a whole.

"Why do you want to move an application for this? Youhave written section 302 IPC in the chargesheet. It will beread as a whole. No need to change the cover," the judge said.

The five accused to be chargesheeted are Ram Singh, hisbrother Mukesh and their accomplices Pawan Gupta, Vinay Sharmaand Akshay Thakur.
