HC Dismisses PIL on Sec 8

HYDERABAD: A division bench of the Hyderabad High Court has dismissed a PIL as withdrawn which questioned the constitutional validity of Section 8 of the AP Reorganization Act. How a statutory provision could be challenged in the form of a public interest litigation?, the bench pointed out.

The bench comprising Acting Chief Justice Dilip B Bhosale and Justice S V Bhatt was dealing with the PIL filed by S Padmanabha Rao and three others.  Senior counsel S Ramachandra Rao, appearing for the petitioners, pointed out that the provision which empowered the Governor as authority was contrary to various aspects of the balance of powers and elected governments.

The bench said there was no public interest involved in the plea and they are inclined to dismiss it. When the counsel requested to grant liberty to withdraw the plea and file a writ petition afresh, the bench has left it open for the petitioner to file a regular writ petition.
