KOCHI: Actor Dileep, who has been languishing in the Aluva Sub-Jail after being arrested in the actress assault case, filed a fresh bail petition before the Angamaly Judicial First Class Magistrate Court on Thursday.The actor filed the plea citing he has completed 60 days in judicial custody and hence, is entitled to a statutory bail.In his petition, Dileep said the first remand report submitted by the investigation team said the criminal conspiracy merely involved capturing nude pictures of the actress.
Hence, the petition contended Dileep is not involved in the offence under Section 376 (D) (gangrape).
Citing the remand report, which levelled 20 charges against Dileep, the defence said the agreement or object of conspiracy specifically pertained to the purpose of taking nude photos and videos. Hence, the charges of gangrape cannot be pressed against Dileep and he is entitled to bail since he has completed 60 days in custody.
The application is filed under section 167(2) (II) of CrPC, which states the accused person in custody for a total period exceeding to 60 days shall be released on bail.
The actor also submitted in the court he would cooperate with the investigation.
This is the fourth time Dileep is submitting a bail petition ever since his arrest on February 17. The petitions were dismissed twice by the High Court and once by the Angamaly court.
Jail visit:
‘No violation of norms’
The Aluva Sub-Jail authorities on Thursday filed a report before the Angamaly Judicial First Class Magistrate Court stating there was no violation of norms regarding the visits by film personalities who called on Dileep in jail. The Jail Superintendent also submitted the details of the visitors from September 2 to September 9. Following a petition by the investigation team against the influx of visitors to the jail, the court had directed the superintendent of the Aluva Sub-Jail to furnish the details of the visitors who met the actor in the jail. In the complaint, the investigators said the visit of a large number of people from outside would affect the course of the ongoing investigation. According to the police, the sudden increase in the number of visitors could be part of an organised attempt to sabotage the investigation.
HC seeks govt view on plea seeking CBI probe
Kochi:The Kerala High Court on Thursday sought the view of the state government on a petition seeking a CBI probe into the actress assault case. The court also adjourned the petition filed by Roy Mammen Joseph, of Kochi, to September 28. According to the petitioner, the police investigation into the case is aimed at paving a way for the real culprits to escape from the clutches of law. The real accused, who is pulling the strings by scripting a story and making Pulsar Suni speak according to it for extorting money, has not yet come under the police scanner. The police have not been investigating the matter fairly, the plea stated. The prosecution objected the plea and submitted that intention of the petitioner was malicious.
Abduction bid: Pulsar Suni gets bail
Kochi: The Ernakulam Chief Judicial Magistrate Court on Thursday granted bail to Sunil Kumar aka Pulsar Suni in the case related to the alleged bid to abduct an actor in 2011. The accused has to execute a bond of B50,000 with two solvent sureties. Besides, Suni needs to surrender his passport. He will have to report before the investigation officer whenever required.
‘Ramaleela’: HC rejects plea seeking protection
Kochi:The Kerala High Court on Thursday declined to pass an interim order on a petition filed by producer Tomichan Mulakuppadom seeking police protection for the release of Dileep-starrer ‘Ramaleela’. The court orally observed that there was no need to interfere in the case at this stage and the averments in the petition were only an apprehension of the petitioner. According to the petitioner, the theatre owners were not ready to screen the movie apprehending public attack. Hence, he sought a directive to the state government to provide all facilities and protection for the release of his film in theatres across the state.
