The Madurai Bench of Madras High Court on Friday cancelled the bail of seven accused in the murder case of DMK functionary and ex-Minister Alagiri’s aide Pottu Suresh observing that there was prima facie evidence against them.
On April 9, the Principal District Judge (PDJ) B Gokul Doss had granted a conditional bail to the seven accused — Saba alias P Sabarathinam, M Santhanam, M Sekar, R Karthik, A Senthil, Raja alias N Nagamurugan and S Lingam — asking them to appear at Pudukottai police station every day until further orders.
The High Court on Friday was hearing an appeal filed by the State Government, challenging the bail granted to the seven accused by the lower court.
The government pleaded that the police have found that the accused were having specific overt acts and all of them were present at the spot when the murder was committed.
Further, the seven accused also had active role in the crime.
Additional Advocate General K Chellapandian contended that the accused were involved in various cases, and submitted the details of the cases in which they were involved.
The AAG also pointed out that the lower court, while considering the bail application, had mentioned that the investigation had been completed. But the same court, while dismissing the bail application in the same order, observed that the investigation was at a preliminary stage.
It is also pointed out to the court that the prime accused ‘Attack’ Pandi and Praveen were still at large and if the accused were released on bail they might try to help him. Admitting the Government’s contentions Justice KBK Vasuki cancelled the bail and adjourned the case to April 16.
