HC Rejects Plea Against DMK MLA's Election

CHENNAI: The election of G Anbalagan of DMK from Kumbakonam Assembly constituency in the May, 2011 election was upheld by the Madras High Court on Tuesday.

Rama Eramanathan (AIADMK) filed a petition to declare the election of Anbalagan as null void. He alleged that Anbalagan indulged in various corrupt practices during the election and the official machinery was used in his favour.

Dismissing the petition, Justice R Mala observed that the petitioner has not satisfactorily proved the charges against Anbalagan. The burden of proving the commission of the corrupt practice is on the petitioner and he has to discharge that burden satisfactorily.

In doing so he cannot depend on preponderance of probabilities. Courts do not set at naught the verdict of the electorate except on good grounds, the judge added.
