Plea to restrain government from filling posts in medical services

CHENNAI : Writ petitions have been filed in the Madras High Court to restrain the authorities concerned from filling the Senior Resident/Assistant Professor posts in the TN Medical Services, by appointing candidates selected to the temporary post of Assistant Surgeon (Specialty) under the walk-in-interview category and contrary to the service rules.Justice T Raja, before whom writ petitions from Dr R Sudhakar and seven others came up for hearing, ordered notice to the authorities concerned, returnable by December 4.

According to advocate G Sankaran, the petitioners were appointed as Assistant Surgeons in TN Medical Services through the TN Public Service Commission under service candidates category and studying the final-year PG course. They will complete the course in April/May 2018 and they will be eligible to be posted as Senior Residents (SRs) or Assistant Professors (APs) in the respective specialty department according to their qualifications on the DME side, as per the rules and orders of the government, based on their CML seniority.

While so, the government has decided to fill several hundreds of posts of SR/AP on the DME side with persons selected for the temporary post of Assistant Surgeon (Specialty) by the MRB through walk-in interview, whereas they are not eligible to be appointed to the posts and there cannot be any action by the government to fill the posts on the DME side without reference to the CML seniority. The right of the petitioners to be posted to the posts could not be taken away, Sankaran contended. Therefore, the petitioners, who are all service doctors, alone should be posted as SRs/APs on the DME side based on the counselling to be conducted following the CML seniority, Sankaran added.
