High Court admits Telangana government plea against acquittals

A division bench of the High Court on Monday admitted two appeals filed by the Telangana government against the acquittal of Mohd Bin Omer Yafai alias Mohd Pahelwan.

HYDERABAD: A division bench of the High Court on Monday admitted two appeals filed by the Telangana government against the acquittal of Mohd Bin Omer Yafai alias Mohd Pahelwan and nine other accused by the VII additional metropolitan sessions court of the city in MIM MLA Akbaruddin Owaisi attack case.

On June 29 this year, the sessions court, after a prolonged trial, had acquitted main accused Mohd Bin Omer Yafai alias Mohd Pahelwan stating that the prosecution failed to establish his involvement in the said attack on Owaisi in 2011. It also acquitted nine others stating that they were found not guilty of the offence. However, it convicted four others and sentenced them to 10 years’ imprisonment. 

Following the verdict, the government filed appeals before the High Court by relying on the opinion of the doctors who said that the MLA had sustained serious injuries and had he not been brought to the hospital, his life would be been in danger. The trial court did not consider this fact, it contended. The government challenged the acquittal of some of the accused and award of 10 years’ imprisonment to the accused and sought enhancement of the sentence awarded to the four convicts.
