Justice Suresh Kumar Kait issued notice and sought responses of Chidambaram and others on the CBI's plea challenging the trial court order directing supply of documents to the accused.
The apex court, while denying anticipatory bail to P Chidambaram in the INX Media case, said it must be left to the discretion of the investigating agency to decide the course of the probe.
INX Media Ltd, which was owned by Mukerjea, had allegedly paid bribes to get a Foreign Investment Promotion Board approval, which was facilitated by ex finance minister P Chidambaram's son.
Karti's father and former Finance Minister P Chidambaram and his wife Nalini Chidambaram were also present in the court wearing black gowns.
Karti, the son of former Union minister P Chidambaram, had moved the high court seeking bail, hours after a court here sent him to judicial custody till March 24.
Justice Kaur, who did not give any reason for her recusal, said she would refer the matter to the Acting Chief Justice for assigning the bail plea to another bench for today itself.
