Customs officials said they will visit Sivasankar at Kakkanad District Jail to record his arrest on Monday evening or Tuesday
The court will consider his bail plea on Monday. A senior Supreme Court lawyer is likely to argue for Sivasankar.
The court also said the contradictions in the ED’s reports about the proceeds of crime cannot come to Sivasankar’s rescue.
The IAS officer also claimed that he was an easy political target because of the post he held.
Social Justice director T V Anupama had earlier made a similar deposition before the customs.
The team had interrogated Swapna at Attakulangara women’s jail in Thiruvananthapuram to seek clarity on the iPhones which were gifted to five persons including Sivasankar as a bribe.
While ED claims Sivasankar was the mastermind behind gold smuggling and money from Swapna’s locker was of the bureaucrat contradict the probe findings of the other two agencies.
The Vigilance had arraigned Sivasankar as the fifth accused in the LIFE mission case.
The ED also submitted evidence against Sivasankar in a sealed cover. The counsel of Sivasankar, however, submitted that the ED is on a mission and their aim is the Chief Minister's Office.
There could be possible kickbacks from certain private parties in these projects, the report said.
The ED requested the court to extend his custody for one more day as several new pieces of information were received after interrogating Swapna Suresh at the jail

Customs officers believe Sivasankar knew that Khalid was travelling to Cairo via Muscat carrying US dollars illegally on August 7, 2019, a top official with the central agency said.
The probe in this regard is in the early stage and the MD of Punnar Industries will be asked to appear before the agency for interrogation.
The court told the ED not to ask for custody of Sivasankar again and produce him back on the expiry of the custody by 11 am on Wednesday.
