The Supreme Court on Friday agreed to take up hearing of the plea filed by DMK leader KR Periakaruppan challenging his loss by one-vote against TVK candidate R Seenivasa Sethupathi in the Tirupattur Assembly Constituency in the 2026 Assembly Elections.

A bench of Justices Vikram Nath and Aparesh Kumar Singh admitted the appeal by the former MLA, who challenged a Madras High Court order of September 28 rejecting his election petition against Sethupathi's victory.

The top court asked the counsel appearing for the respondents, including Sethupathi, to file their counter affidavits within six weeks, keeping all relevant records relating to the election shall remain intact.

Senior advocate Amit Anand Tiwari appeared for the DMK leader.

KR Periyakaruppan lost the Tirupattur Assembly constiuency by one-vote securing 83,374 votes against 83,375 votes of TVK's R Seenivasa Sethupathy. The results were declared on May 4.

In a plea filed with the apex court, it said: “The high court has rejected the appellant's election petition at the threshold. It is respectfully submitted that the single judge has committed a grave error by testing the election petition on proof rather than on pleadings, without considering the crucial facts."
