The police have challenged the January 29 order of a sessions court, which dismissed its plea against the magistrate’s decision mandating the supply of the document list to Bibhav Kumar.
Court has ordered that Kumar not be reinstated as a personal assistant or assigned any official duties within the Chief Minister's office while on bail.
In its affidavit, the Delhi Police argued that Kumar, being an influential and powerful individual, might influence witnesses and tamper with evidence.
AAP Rajya Sabha MP Maliwal was allegedly assaulted at the residence of the CM at civil lines in north Delhi on May 13 following which the Delhi Police arrested Bibhav.
The court said that the fact that the mobile phone seized from the petitioner (Kumar) was also formatted prior to seizure, also reflects that there is an effort to conceal some vital evidence.
