Chief Ministers have no role in BDA, yet Yeddyurappa gave orders: ACB

BENGALURU: Former chief minister B S Yeddyurappa had recommended to the Bengaluru Development Authority (BDA) to drop certain parcels of  land proposed to be acquired for Dr Shivaram Karanth Layout from the final notification during his tenure, even though the CM has no role in the BDA as per the BDA Act, the ACB counsel told the High Court on Monday.

He was arguing in two cases filed by Yeddyurappa against the ACB for filing two FIRs against him for allegedly illegally denotifying 257 acres of land.

The ACB counsel said that BSY started receiving requests for denotification of land from April 23, 2010. Citing one such request, the counsel said one Asha Pardeshi submitted an application seeking dropping of certain pieces of land from the final notification, claiming she was the owner of said land.

“Interestingly, she hadn’t even signed the application which was directly submitted to Yeddyurappa. The lands which she sought for denotification were not in her name at all. She was not even the GPA holder. The ACB is unable to trace her till today,” he said. He added that Yeddyurappa had passed 20 orders recommending to BDA to drop lands from the final notification. BDA issued endorsement whenever he passed such orders.

“What is interesting is that after Yeddyurappa resigned as CM, his successor D V Sadananda Gowda agreed to get the case investigated by CID after he faced the wrath of the legislators in the House on April 3, 2012. But the matter was never entrusted to the CID,” the counsel argued.  

As the case was adjourned to Wednesday for want of time and also to enable ACB to file objections, the counsel extended its undertaking that it will neither arrest nor summon Yeddyurappa till next date of the hearing.
