The CBI special court, which ordered a reprobe into the Kaviyoor sex scandal case, dismissed Unnikrishnan Namboothiri’s plea for taking up criminal procedures against the investigating official for furnishing false statements. It also dismissed the petition filed by former ministers and CPM leaders Kodiyeri Balakrishnan, M A Baby and P K Sreemathi, who had sought action against Nandakumar for fabricating evidence and attempting to malign them and derail the investigation in the case.
The CBI had earlier submitted in its follow-up investigation report that no politician or VIP was involved in the Kaviyoor sex scandal case.
Moreover, the investigating agency had demanded appropriate action against Nandakumar for attempting to derail the investigation. It had said that Nandakumar had tried to coerce key accused Latha Nair to fabricate evidence against politicians and other persons.
In the investigation report, the CBI said that Latha Nair mentioned that Nandakumar wanted her to name CPM leaders M A Baby and his son, Kodiyeri Balakrishnan and his son, P K Sreemathi and Thomas Chandy MLA, so as to teach the CBI a lesson.
“Nandakumar had offered a sum of Rs 50 lakh to Rs 1 crore for this,” the CBI submitted. “In her statement, Latha Nair had also said that Anagha’s father Narayanan
Namboothiri alone had sexually abused Anagha,” according to the CBI report.
Nandakumar, in his petition, said that prime accused Latha Nair had not been subjected to a thorough investigation. He also said that the CBI had not further investigated its finding that Anagha was subjected to sexual harassment for 15 to 20 days before her death. He also said that the CBI was merely relying on Latha Nair’s statement that Narayanan Namboothiri had alone sexually assaulted Anagha. Anagha, along with her father, mother Sreedevi, sister Akhila and brother Akshay were found dead in their rented house in Kaviyoor near Thiruvalla on September 28, 2004.
