The police didn’t arrest the CEO and directors when they appeared before them on May 15, almost a week before the warrant was issued. Though there were four cases registered against Amway in Wayanad, the arrest was made only in three cases for which the warrant was issued, the ADGP’s report noted. It said the Amway honchos were allowed to consult their lawyer. Moreover, neither the company nor the accused lodged any complaint against the investigators. Sources claimed the police action was substantiated by a 2007 Andhra Pradesh High Court order that Amway’s business model attracted the definition of a “money circulation scheme” as provided in Section 2(c) of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978. The HC order was subsequently upheld by the Supreme Court.
