Bitti case: HC stays order on DNA test

Express News Service

The Kerala High Court on Tuesday stayed the order of the Thalassery Additional District and Sessions Court which granted permission to the police to conduct DNA test on Bitti Mohanty who was arrested on charges of impersonation, forgery and cheating.

Justice K Harilal issued the interim order on a petition filed by Bitti, son of former Odisha DGP B B Mohanty, challenging the order of the Sessions Court granting permission to conduct a DNA test on him to obtain scientific proof of establishing his identity.

Mohanty, who was sentenced to seven years’ imprisonment on rape charges in November 2006, had jumped parole and gone absconding. He was arrested on March 9 from Kannur, where he was working as a probationary officer in a State Bank of Travancore branch as ‘Raghav Rajan’ of Andhra Pradesh. The petitioner claimed that he is not Bitti but Raghav Rajan.

He further submitted that though the police took him to the jail in Rajasthan for collecting evidence, nothing could be traced. He further submitted that even if a DNA test is conducted on him, his parents or relatives will not agree to give samples to verify the same.
