HC Tells Officials to Vacate Inmates from Islamic School Building

The High Court on Wednesday said there shall be no construction on the premises of the Islamic Arabic school at Thondawada village near Tirupati.

A team comprising revenue divisional officer (RDO), deputy superintendent of police (DSP) and others shall visit the alleged illegal structure and ascertain when the inmates will vacate if they are there.

Justice Nooty Ramamohana Rao passed these orders in a batch of writ petitions. The structure in question was constructed by Madarasa-e-Niswan-Isha-Atul-Islam Urdu and Arabic Development Society, through its president Shaik Nowhera. The society filed a writ petition contending that Tondawada gram panchayat is threatening to demolish the building though they are ready to pay regularisation fee for the extra floors constructed.

Another writ petition was filed challenging the orders of the district collector, who directed the local panchayat to demolish the portions of the structure which have come up violating the sanctioned plan.

The Tirumala Tirupati Samrakshna Samithi (TTSS) filed a petition to implead into the case and opposed grant of any interim orders. S Muni Gangi Reddy, former sarpanch of Chandragiri, filed a separate writ petition seeking demolition of the structure.

The judge wanted the management of the Islamic institution to explain how six floors had been constructed when permission was only for the ground and first floors. The counsel for the petitioner society said there are several TTD buildings which do not have sanctioned plan and they (the petitioner) are being victimised. The judge said the land on which the building stands was once a tank. So, the safety of such a huge structure is an issue concern, he said. The case will be listed after two weeks for affidavits by officers and Tirupati Urban Development Authority (TUDA) records.

Meanwhile, the TTSS on Tuesday sought Governor ESL Narasimhan’s intervention to stop the construction.
