HC grants relief to pvt firm in mining lease case

HYDERABAD: In a relief to a private company, the Hyderabad High Court has set aside the memo issued by authorities for rejection of lease application of the company. The court held that the state government cannot go back on its promise of granting of lease, once compelled a person to pay the amount and to purchase lands for afforestation.

Justice AV Sesha Sai was dealing with a plea by Exotic Granites Exports of Hyderabad seeking to declare state’s action in directing the erstwhile AP Mineral Development Corporation to reject its lease application and according mining lease to the corporation by overlooking the priority, as illegal. The judge, while allowing the petition directed, state government to consider the petitioner’s application for grant of lease in accordance with law.
