SC notice to UP on transfer plea against Cabinet

NEWDELHI: The Supreme Court on Monday issued notices to Uttar Pradesh Government and other respondents on a petition seeking transfer of the petition questioning the validity of Shashank Shekhar Singh’s appointment as the Cabinet Secretary of the state.

  A Bench comprising Justice H L Dattu and Justice C K Prasad also directed the

Centre and Singh to file their replies on an application which said that the validity of Singh’s appointment needs to be examined.

  The Bench was hearing a PIL filed by one Harish Chandra Pandey from UP.

He alleged that Singh does not belong to IAS cadre, but he has been occupying the IAS cadre posts for the last 20 years.

Initially, he was appointed as a pilot in the state government in 1979 and later was promoted as the Director of Civil Aviation in  1982. Thereafter, he was posted to various posts of the IAS, pointed out senior counsel Abhishek Singhvi appearing for Pandey.

The petitioner averred that such posting continued for many years and neither the state government nor the Centre had taken up any step to end this illegal usurpation of office.
