Nomination of 5 MLCs by Governor upheld

A division bench of the High Court comprising acting chief justice PC Ghose and justice Vilas V Afzulpurkar on Friday dismissed a writ petition challenging the nomination of five persons to the state legislative Council by the governor.

 The nominees included Council chairman A Chakrapani, D Rajeshwar Rao, R Reddappa Reddy, Farooq Hussain and A Laxmi Shiva Kumari.

 A public interest petition was filed in the court by V Venkateswar Rao of the city stating that the nominees were not persons of great renown in the fields of arts, science, literature or social work.

 He contended that the constitutional power to nominate persons of eminence was being abused to rehabilitate those who had not been successful at the hustings.

 The reasoning of the bench to dismiss the petition was not immediately available.

 An oral application seeking leave to appeal before the Supreme Court was also rejected by the bench.
