MYSORE: Cooperation Minister H S Mahadeva Prasad had filed a false affidavit declaring that he does not own a site or house while buying a site from Karnataka Housing Board (KHB), according to a Lokayukta report.
The report was submitted by Superintendent of Police SM Jagadish Prasad, Mysore division, to District Principal and Sessions Court Judge V G Sawadkar in Chamarajanagar on Tuesday. In June, the Court had directed SP Prasad to investigate the matter and file a report by September 30. Sources told Express that the charges of criminal breach of trust and cheating levelled by Nandish, a former follower of the accused, were not established in the investigation. But charges of false declaration under 199 of the IPC have been proved.
However, Nandish has no power to challenge it without prior permission of the government. As per law, only the competent authority (here KHB) or the government has the power to approach the court against a false declaration by a minister.
When contacted, SP Prasad refused to divulge details of the investigation, stating that the matter is before the court which is expected to pass the final order soon.
In his complaint, Nandish alleged that Mahadeva Prasad had filed a false affidavit stating that he doesn’t have site or house while buying a site from KHB in 1998, though he had already built a house in Mysore in 1996.
