CHENNAI: No Person, Whatever be the religion, has any inherent right to use speakers which exceeds the decibel limits imposed by the statutory Noise Pollution (Regulation and Control) Rules, 2000, the first Bench of Chief Justice Indira Banerjee and Justice M Sundar observed on Wednesday while admitting a PIL from Shah Nawaz Khan, president of Pollachi Aykkiya Jamath seeking to restrain the authorities from seizing or confiscating the sound equipment belonging to the mosques without examining the decibel levels.
He also sought to restrain them from infringing on the rights of the mosques to call the faithful for prayers five times a day through the system within the permissible limits.
The Bench granted liberty to the petitioner to file an affidavit furnishing the particulars of alleged illegal action by September 1. The Bench posted the matter for further hearing on September 4.
