7 years later, Delhi cop finally wins legal battle against Axis bank

NEW DELHI:  A Delhi Police officer, who is part of the justice deliver system, has fought hard for justice. Assistant Commissioner of Police Mohan Singh Bais got stuck in a seven-year-long legal battle before justice was delivered.

In an unauthorised transaction, 20,000 was withdrawn from Bias’s account using an ATM. “In 2009, I received SMS alerts on my phone that amounts of 7,000, 7,000 and 6,000 were debited from my salary account. I always keep pin code secret and never given my ATM card to anybody. I informed the bank officials about it and they credited the money back into my account. But a month later, similar transactions took place from my account again,” the 58-year-old officer told The Sunday Standard.

He found that a total of 20,000, in three transactions, has been withdrawn from his Axis Bank account. As it happened for the second time, Bais approached the Consumer Disputes Redressal Forum, which passed the order in his favour in 2012.

The bank challenged the order at the Delhi State Consumer Disputes Redressal Commission, which dismissed the plea in May this year.

The court had stated in its order “that 20,000 be re-credited, further an amount of 10,000 also be given for causing mental tension and financial harassment to the complainant”.

The order further stated, “Undisputedly in the present matter even on specific request of the complainant the bank has failed to provide CCTV footages to the complainant to satisfy himself from the transactions alleged by him. Such an act of the bank has given rise to an inference that there is a chance of such misuse of the ATMs by fraudsters.”

“The battle lasted for seven years, but finally the truth prevailed,” said Bais, who is presently posted at the Crime Against Women Cell in the South District.
